2. Description of Goods and Services
Penchant Fine Jewellery designs, manufactures, repairs, remodels, and sells fine jewellery, including bespoke and custom-made pieces.
3. Quotations and Pricing
- All quotations are valid for 48 hours, unless otherwise stated.
- Pricing is subject to fluctuations in:
- Precious metal markets (e.g. gold, platinum)
- Foreign exchange rates
- Diamond and gemstone pricing
- Penchant Fine Jewellery reserves the right to adjust pricing prior to final confirmation where input costs materially change.
- Acceptance of a quotation—whether via written confirmation or payment—constitutes acceptance of these Terms & Conditions.
4. Deposits and Payments
- A deposit of 50%–75% is required to commence production on custom orders, special orders, or repairs.
- The balance is payable prior to delivery or upon collection.
- Deposits are non-refundable once production has commenced.
- Accepted payment methods:
- EFT (Electronic Funds Transfer)
- Visa and MasterCard
5. Custom-Made and Special Orders
- All custom-made, personalised, or specially sourced items are final sale and not eligible for return, refund, or exchange.
- Client approval of designs, CAD renders, or sketches constitutes final acceptance.
- Any changes requested after approval:
- May incur additional costs
- May impact delivery timelines
- While every effort is made to match designs precisely:
- Minor variations in finish, dimensions, and weight may occur
- Natural gemstones may vary in colour, clarity, and appearance
- Production timelines are estimates and may be affected by manufacturing or supplier constraints.
6. Repairs, Resizing and Customer-Supplied Items
- All work on customer-supplied jewellery is undertaken at the client’s risk.
- Penchant Fine Jewellery shall not be liable for:
- Damage to fragile or previously worn items
- Stone loss or damage during resizing, setting, or removal
- Unknown metal compositions or structural weaknesses
- No guarantees are provided on repairs to previously worn or altered jewellery.
7. Delivery Policy
- Orders are processed within a reasonable timeframe, subject to availability and payment confirmation.
- Delivery options:
- Local courier within South Africa (fee applies)
- International shipping (fee applies)
- Risk in the goods passes to the customer:
- Upon delivery by courier, or
- Upon collection
- Customers are responsible for providing accurate delivery details.
8. Ownership
All goods remain the property of Penchant Fine Jewellery (Pty) Ltd until paid for in full.
9. Returns, Exchanges and Refunds
- Refunds are not offered for change of mind.
- In accordance with the Consumer Protection Act (CPA), customers are entitled to remedies where goods are:
- Defective
- Damaged
- Not as described
- Exchanges or credit notes may be granted at the company’s discretion, subject to:
- Return within 7 calendar days
- Item unused and in original condition
- Original packaging and certificates included
- Custom-made, engraved, or altered items are not eligible for exchange or credit.
- Credit notes:
- Valid for 6 months
- Non-refundable and non-transferable
10. Valuations
- Valuations are provided for insurance purposes only.
- Valuations:
- Do not represent resale value
- May vary over time due to market conditions
11. Customer Responsibilities
Customers are responsible for:
- Confirming correct ring sizes and specifications
- Insuring jewellery after collection or delivery
Penchant Fine Jewellery is not liable for loss, theft, or damage once goods have been delivered or collected.
12. Privacy Policy (POPIA Compliance)
Customer Privacy policy
Penchant Design shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: Click Here
Penchant Fine Jewellery processes personal information in accordance with the Protection of Personal Information Act (POPIA).
Customer information is collected for:
- Order processing
- Communication
- Legal and compliance purposes (including FICA where applicable)
We take reasonable steps to:
- Safeguard personal data
- Prevent unauthorised access
Customers have the right to:
- Request access to their personal information
- Request correction or deletion where applicable
13. Payment Security
- Card transactions are processed via secure third-party payment gateways.
- No card details are stored on Penchant Fine Jewellery systems.
14. Governing Law
These Terms & Conditions are governed by the laws of the Republic of South Africa.
Any disputes shall be subject to the jurisdiction of South African courts.
15. Limitation of Liability
To the fullest extent permitted by law, Penchant Fine Jewellery shall not be liable for:
- Indirect or consequential losses
- Delays caused by suppliers or external factors
- Variations inherent in handmade or natural products
16. Amendments
Penchant Fine Jewellery reserves the right to update or amend these Terms & Conditions at any time without prior notice.
17. Warranty
At Penchant Fine Jewellery, every piece is crafted to the highest standards. To support this commitment, each purchase includes access to our Warranty, designed to protect and preserve your jewellery over time.
17.1 Limited Manufacturing Warranty
- All jewellery is covered by a 6-month limited warranty from the date of collection or delivery against manufacturing defects.
- This includes:
- Faults in craftsmanship
- Defects in materials used during manufacture
- Where a valid claim is confirmed, Penchant Fine Jewellery will, at its discretion:
- Repair the item at no cost, or
- Replace the item where repair is not feasible
17.2 Recommended Maintenance
- Customers are encouraged to have their jewellery inspected at least once every 12 months.
- Regular maintenance helps prevent stone loss and prolongs the life of the piece.
- Failure to maintain reasonable care may impact future service eligibility.
17.3 Exclusions
The warranty and care programme does not cover:
- Normal wear and tear (including scratches, dents, or surface damage)
- Loss of stones due to impact, wear, or lack of maintenance
- Damage caused by:
- Misuse, negligence, or accidents
- Exposure to chemicals, perfumes, or harsh environments
- Items that have been altered, repaired, or handled by third parties
- Customer-supplied materials or stones
17.4 Stone Security Disclaimer
- While every effort is made to ensure secure stone setting, all fine jewellery is subject to wear over time.
- Penchant Fine Jewellery is not liable for stone loss unless directly attributable to a verified manufacturing defect within the warranty period.
17.5 Warranty Conditions
- All warranty claims are subject to assessment by Penchant Fine Jewellery.
- The warranty is:
- Non-transferable
- Valid only for the original purchaser
17.6 Extended Services (Chargeable)
Services outside the scope of the warranty—including resizing, restoration, or replacement of lost stones—will be quoted separately.
